§ 1 Conditions of Use

These terms and conditions (hereinafter “the terms”) apply to the customer’s purchase of all services or products offered by Danes Worldwide or Den Danske Sommerskole (hereinafter collectively “the companies”) via danes.dk and members.danes.dk, including both the Danish and English versions of the websites (hereinafter collectively “the website”), unless otherwise expressly agreed in writing.

§ 2 Company Information

Danes Worldwide and Den Danske Sommerskole are two separate legal entities. The Summer School and the Family Summer School are part of the self-governing institution Den Danske Sommerskole, while Danes Worldwide is a membership association offering Danish language courses, legal advice, and case processing to its members. The customer enters into an agreement with the company offering the relevant service or product. Danes Worldwide and Den Danske Sommerskole are not liable for each other’s obligations towards the customer.

§ 3 Prices

Subsection 1. All prices on the website are in Danish Kroner (DKK). 

Subsection 2. Membership fees and Danes Worldwide’s Danish language tuition are exempt from VAT. Legal case processing is subject to VAT.

Subsection 3. Den Danske Sommerskole reserves the right to subsequently charge VAT if, as a result of changes in legislation or administrative practice, it is determined that the relevant services are subject to VAT and that VAT should therefore have been charged at the time of purchase.

Subsection 4. The total price for the service and/or product is the price stated on the website at the time the customer makes the purchase, unless otherwise expressly stated.

Subsection 5. The companies reserve the right to make ongoing price changes. Price changes do not apply to agreements already entered into. Reservations are made for any printing errors.

§ 4 Payment

Subsection 1. Payment can be made with Dankort, VisaDankort, e-Dankort, Visa, MasterCard, Maestro, American Express, Visa Electron, Apple Pay, Google Pay, or MobilePay.

Subsection 2. Payment via bank transfer is possible. This must be done as soon as possible and no later than 7 days after ordering.

Subsection 3. If payment is made by credit card, a fee is charged for credit card payments made with private credit cards issued outside the EU as well as for all company cards regardless of the country of issue. For all types of cards, the card issuer may also charge a fee in connection with the payment.

Subsection 4. The customer’s credit card information is encrypted. The companies only receive necessary information to identify the order ID being paid for.

Subsection 5. The payment mediator, QuickPay, uses the security protocol SSL, which encrypts all transfers of customer information. This means that the customer’s card information is protected during the transfer from the website via QuickPay to NETS. § 5 Personal Data

The customer’s personal data is processed and transmitted in encrypted form when purchasing services and/or products on the website. Personal data in connection with the customer’s purchase is stored for as long as the customer relationship exists and for up to 5 years after the customer relationship has ended, unless longer retention is required by law. § 6 Delivery

The companies either send via PostNord A/S or DHL. Costs associated with this are borne by the customer as a starting point, unless otherwise agreed in writing.

§ 7 Right of Withdrawal

Subsection 1. The customer has a 14-day right of withdrawal from the time of purchase.

Subsection 2. If the customer wishes to withdraw from their purchase, the customer must submit an unambiguous written statement to the relevant company within the deadline.

Subsection 3. By accepting the terms and conditions, the customer also consents to the company beginning delivery of the service and/or product immediately from the time of purchase.

Subsection 4. If the customer exercises their right of withdrawal after all or part of the service and/or product has been delivered, but before the expiry of the 14-day withdrawal period, the company will charge payment for the product or service already delivered. The amount charged by the company will be proportionate to the extent of the service already delivered compared with the full performance of the agreement.

Subsection 5. Special exceptions and limitations to the right of withdrawal apply to certain services and/or products, cf. §§ 13-16.

§ 8 Complaints

Subsection 1. As a general rule, the customer has a two-year right to complain under the rules of the Danish Sale of Goods Act, calculated from receipt of the product. For services, complaints may generally be made within 3 years after the error was discovered or should have been discovered. Vandalism, misuse, or similar circumstances are not covered by the right to complain.

Subsection 2. Complaints regarding defects or deficiencies must be submitted in writing to the company within a reasonable time after the error was discovered or should have been discovered. The customer must specify the particular defects or deficiencies in the product.

§ 9 Choice of Law

The customer’s order placement and purchase on the website are subject to Danish law, including the Danish Consumer Contracts Act. In the event of any discrepancy between the Danish and English versions of the terms and conditions, the Danish version shall prevail.

§ 10 Force majeure

If the customer’s purchased product and/or service cannot be delivered/processed either wholly or partially due to entirely extraordinary situations, such as – but not limited to – acts of war, terrorism, epidemics, fire, natural disasters, state bankruptcies, blockades, embargoes, sanctions, breakdowns in public and/or private infrastructure, including longer-term consequences that can be characterized as force majeure, the companies are neither directly nor indirectly liable for compensation. The customer is not entitled to a refund, either in whole or in part.

§ 11 Reservation

The companies reserve the right to correct printing errors, price errors, obvious errors, and VAT and tax changes. Any offers apply while capacity is available.

§ 12 Special Conditions

Subsection 1. Danes Worldwide offers online Danish language teaching, legal advice, and case processing. Den Danske Sommerskole offers stays at the Summer School and Family Summer School. Special conditions apply to the individual services and products.

Subsection 2. Purchase of services and/or products on the website requires a valid and active membership throughout the entire period in which the service is delivered or the product is used.

§ 13 Den Danske Sommerskole 

Subsection 1. The following applies in the event of full or partial cancellation by either Den Danske Sommerskole or the customer regarding stays at the Summer School or Family Summer School.

Subsection 2. If the customer cancels no later than the end of the day Danish time on 31 January in the year of the stay, the course fee will be refunded, except for the registration fee.

Subsection 3. If the customer cancels, for any reason, after 31 January in the year of the stay, the course fee, less the registration fee, will only be refunded if the place can be allocated to another participant.

Subsection 4. If the conduct of the Summer School or Family Summer School should be wholly or partly prevented or canceled due to entirely extraordinary situations, such as – but not limited to – acts of war, terrorism, epidemics, fire, natural disasters, state bankruptcies, blockades, embargoes, sanctions, breakdowns in public and/or private infrastructure, including longer-term consequences that can be characterized as force majeure, Den Danske Sommerskole is neither directly nor indirectly liable for compensation. Registered participants for the Summer School and/or Family Summer School are not entitled to a refund, either wholly or partially.

Subsection 5. The provisions in subsections 6-8 concern the stay at the Summer School and Family Summer School and apply to the participants. Parents or other guardians participating in the Family Summer School are also covered; however, the rules on consumption of alcohol and use of tobacco and nicotine products do not apply to these adult participants.

Subsection 6. The Summer School and Family Summer School enforce a zero-tolerance policy regarding the possession and/or consumption of alcohol, tobacco and nicotine products, and narcotic substances. The prohibition includes all forms of smoking and vaping, including – but not limited to – cigarettes, electronic cigarettes, and vapes, regardless of whether they contain nicotine. Any participant found to be in possession of, under the influence of, or to have consumed such products or substances will be expelled without notice and with immediate effect and sent home. A parent or guardian will be informed immediately. No full or partial refund of the participation fee will be given in the event of expulsion due to violation of this provision.

Section 7. By participating in the Summer School and/or Family Summer School, the participant undertakes to behave in a respectful, responsible, and proper manner towards fellow participants and staff. Actions such as – but not limited to – physical violence, threats, bullying, offensive or inappropriate behavior, humiliation of others, and sharing offensive, abusive, or illegal material are not accepted. Violation of this provision may, depending on the nature and severity of the action, result in one written warning to the participant and their parent or guardian. In the case of serious violations, however, the participant may be expelled and sent home from the Summer School and/or Family Summer School without prior warning and with immediate effect. The assessment of the seriousness of the action and the relevant sanction is made solely by the management of the Summer School and/or Family Summer School. Expulsion due to violation of this provision does not entitle the participant to any full or partial refund of the participation fee.

Section 8. Participation in the Summer School and/or Family Summer School requires that all participants and/or parents or guardians have read and accepted the contents of the relevant year’s parent information, which is sent upon admission to the summer school stay.

§ 14 Danes Worldwide’s Danish language tuition 

Subsection 1. For all Danes Worldwide’s online Danish lessons, it applies that registration and purchase of lessons are binding after the lessons begin. In case of cancellation within 14 days from the time of purchase and before the lessons begin, the course fee will be refunded, except for an administration fee of 750 DKK per student. Once the lessons have started, the customer cannot cancel the purchase. 

Subsection 2. If the customer interrupts their membership for any reason while or before the lessons are completed, the customer will be sent 1 reminder about this. If the customer does not respond to the reminder within a reasonable time, Danes Worldwide will immediately terminate access to the online lessons and notify the customer. 

Subsection 3. With any purchase of online Danish lessons, the customer will have access to the course from the start of the course until one month after the course ends. For the purchase of a complete course (e.g., Beginner Danish A1, which consists of 3 periods of 10 weeks each), the periods are consecutive. Danes Worldwide guarantees that assignments submitted by the deadline will receive personal feedback. 

Subsection 4. Danes Worldwide disclaims any responsibility if the customer cannot get the online lessons to work due to technical challenges, such as, but not limited to, failing/unstable internet connection, technical issues, geo-blocking, outdated technology, local conditions, weather conditions, etc. 

Section 5. In the event of cheating, plagiarism, or similar actions, the teacher at Danes Worldwide may immediately, upon discovery, give the parent or guardian and/or the student one written warning. In case of a second violation, the parent or guardian and/or the student will be informed that Danes Worldwide reserves the right not to grade the student’s assignments for the rest of the period or school year – without any form of refund. 

Section 6. If a student enrolled in the 9th-grade Danish language course at Danes Worldwide is found guilty of cheating or similar misconduct, § 14, Section 5 will apply. In addition, the student will forfeit the right to sit for the 9th-grade exam at the Danish Summer School – again, without any form of refund. However, the student will still be permitted to participate in the Danish Summer School. 

§ 15 Case Processing

Subsection 1. Purchase of case processing with Danes Worldwide requires a valid and active membership of Danes Worldwide, which must be maintained and, if necessary, renewed on an ongoing basis throughout the entire period during which the case is processed, including periods during which the case is, for example, pending before relevant authorities.

Subsection 2. If the customer, for any reason, interrupts their membership with Danes Worldwide either while and/or before the case processing has been completed, the legal advisory will send the customer at least 2 reminders to remind the customer that case processing requires a membership of Danes Worldwide in order for the case processing to continue.

Subsection 3. If the customer, for any reason, does not respond within a reasonable time to the final reminder, the legal advisory may suspend the customer’s case processing until payment for the membership has been registered.

Subsection 4. If the customer, for any reason, does not respond regarding their case or membership within 2 years, calculated from the customer’s last contact, the legal advisory will delete the customer’s case without notice. After the expiry of this deadline, the customer cannot reopen the case and must purchase the desired case processing again.

Subsection 5. Danes Worldwide cannot guarantee a positive outcome of the customer’s application and/or case before the relevant authorities. In the event of rejection or another negative outcome of the customer’s application and/or case before the relevant authorities, which Danes Worldwide has assisted with, the customer is not entitled to a refund, either in whole or in part.

§ 16 Legal Advice

Subsection 1. A membership with Danes Worldwide gives the right to up to 30 minutes of legal advice per membership year. The advice is provided exclusively by telephone or email.

Subsection 2. All forms of advice and/or guidance provided by Danes Worldwide to the customer are subject to errors and omissions. Danes Worldwide is neither directly nor indirectly liable for compensation. The customer cannot demand either a full or partial refund of any membership fee or case processing in case of errors and/or deficient advice.

Subsection 3. If the customer’s question cannot be answered by Danes Worldwide, the question, only by email and with the written consent of the customer, may be forwarded to one or more of Danes Worldwide’s external experts. Once the customer has been referred to the expert, Danes Worldwide is no longer involved in the process, and the customer is referred to the terms and conditions of the respective expert’s business.

§ 17 Membership

Subsection 1. Membership of Danes Worldwide is ongoing until the time the membership is paid up to.

Subsection 2. If the customer wishes to cancel their membership of Danes Worldwide in the middle of a membership period, it will only take effect from the following membership year. This also applies to cancellations due to dissatisfaction with services included in the membership. The right of withdrawal mentioned in § 7 only applies to new memberships.

Subsection 3. Danes Worldwide offers the following memberships:

No. 1. Membership: A membership can be purchased for 1 year, 2 years, 5 years, or as a lifetime membership. The membership includes the member as well as their spouse/partner and children under the age of 18 living in the same household.

No. 2. Youth membership: A youth membership is personal and may only be used by the holder. The membership is for people between the ages of 18 and 26 and does not provide access to the purchase of case processing.
